Establishment of Child Support and Modification
While the state of Ohio has a standard computer program which sets the minimum or supposed amount of child support between two parties for the care and control of their child bases upon the parties’ respective incomes, there is more to it than a simple theorem. Deviations can be made upward or downward depending on factors such as the time spent with the child, the amount of out-of-pocket expenses relating to the child and the cost of the child’s healthcare. Further in cases where the parties earn more than $150,000, there are technically no guidelines for child support but rather the court figures child support on a case-by-case basis. If one of the parties or both parties’ income substantially changes, modifications to child support can be made. A knowledgeable attorney is a must for the party who wants a fair and equitable amount of child support to be ordered.
